Corby parole hopes dashed after law loophole closed

A judge said Tuesday he was not convinced that the former South Carolina police detective who spent 14 years in prison for raping and killing a young man had indeed been the victim of a coerced confession.

Judge Richard A. Gant, who heard testimony in a re-examining of the case Tuesday, said he was not convinced that Det. Daniel Murray was not subjected to a form of sexual abuse and coercion during his 13 years in prison for the slaying of Charles Ward, 28.

Gant said Murray's allegations were "entirely credible."

The hearing is expected to be closed by noon, but Gant told reporters that he was waiting for the results of a forensic analysis done during Murray's trial, and that he was confident that a rape victim could have been coerced into giving a coerced confession.

"I'm not going to tell you exactly what I heard today and I've had an experience in court where I've been blindsided by information that could have given me a better idea of what happened in this case," Gant said. "That's why it took several months."

Gant said there were several major issues regarding Murray's allegation and a lot of other circumstantial evidence the state offered during the trial, including video evidence from the crime scene and photographs taken by a witness.

Gant said prosecutors presented a "burden of proof" of their case, saying, "It's not just a question of a suspect confessing. The prosecution has to prove beyond a reasonable doubt that it is the suspect that was the victim here. It's not just a case of one man or a crime that happened in an isolated neighborhood. This is about as isolated an area as I've ever seen in the state of South Carolina."

The judge asked the prosecution for copies of the photographs used to show a group of children in a yard at the scene of the crime, and for information about Murray's alleged role in the child molestation investigation from 2013 to 2012.

"We've got the testimony of so many people who say they see evidence of how serious this was, that I really am not convinced that he's the suspect in this case," Gant said.

The judge did not rule as to whether Murray is innocent or guilty. He ruled only that "the case will not have a prejudicial effect on the court's consideration of the defendant's request for pardon," as if he were not entitled to a hearing on the request after serving the 14 years he had already served.

The trial, which started in October 2014 and ended Thursday with four days of testimony, is the third of a series of challenges to Murray's conviction on child molestation charges.

"At a minimum this would require the UK Government to put in place a workplace rights plan to ensure workers receive the highest possible standards of pay and working conditions that they have ever worked under in their life.

"At a minimum that would require Labour's own policy that we now accept is inadequate and so it is time the UK Government put forward a different vision for those workers in this industry."
